Alert - Loch Fyne Access Issues
Updated - 13/01/09 UP

Members may be aware that access to the shore road between Argyll Caravan Park and Furnace Quarry has recently been blocked following the installation of locked gates. The road provides access to dive sites including Kenmore Point, Stailion Rock and others. We understand that the Landowner and estate has taken these steps for reasons which include quantities of rubbish being dumped on the estate land, illegal camping, threats against staff and other anti social activity.

The Access Manager for Argyll & Bute Council reports that he has met with the factors for Argyll Estates and Kenmore Forestry who own the majority of the solum of the Shore Road between Furnace and Inveraray.  The argument for managed access for diving was discussed with factors.  The next stage is for the Access Manager to write a report outlining the issues for all interested parties and recommending managed access as the best compromise.  This report will then be circulated to the landowners and the twenty or so residents along the Shore Road who have private rights of access to use the road in their title deeds.  In addition the Furnace and Inveraray Community Councils, Local Elected Members, SSAC and other interested parties will receive copies.  Following this a meeting will probably be held with the residents to gauge their support for this approach.  The Access Manager has stated that this will take a couple of months to complete because of his workload.

The Access Manager has also advised that no attempt will be made to assert the road as a Vehicular Public Right of Way until all attempts to negotiate a solution have been exhausted.  This is primarily because similar cases are taking 3 to 5 years to resolve in court and the Local Authority can be left with legal costs of several hundred thousand pounds in the event that the case is lost.  However it is still worthwhile to collect evidence of use since it will help to support the argument for managed access for divers or if in the event that a legal case is required it will still be needed.

Therefore, SSAC is trying to gather evidence to support the claimed Vehicular Public Right of Way, and are receiving support from Argyll & Bute Council.  If you have dived the area pre 1988, and have evidence such as a diving logbook then please assist by completing the questionnaire. Evidence may include photocopies of logbooks or dive books/guides. Please return completed questionnaires and evidence to SSAC Headquarters, The Cockburn Centre, 40 Bogmoor Place, Glasgow , G51 4TQ.

We advise divers not to travel to Furnace expecting to be able to access the dives at Kenmore until this situation has been resolved.  SSAC is involved in trying to negotiate access on behalf of divers and any actions that may compromise these negotiations will not be appreciated nor in anyone’s interest.

If you have any further queries on this matter please contact ScotSAC Access Officer
